Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms") govern the sale of jewelry by Joar Paris to its consumer customers, in France and internationally, via the joar.paris website. Any order placed on the website implies full and unconditional acceptance of these Terms.

2. Products

JOAR Paris designs and sells jewelry in gold and diamonds. In accordance with French regulations on precious metals, each gold piece bears a guarantee hallmark certifying its purity. Where applicable, diamonds may be accompanied by a certificate of authenticity or quality. Product photographs and descriptions on the website are as accurate as possible but cannot guarantee a perfect likeness, notably due to the characteristics specific to each stone and to on-screen display.

3. Price

All our prices are shown in euros (€), all taxes included, including for orders delivered outside the European Union. Due to the made-to-order manufacturing process and production time (see article 6), the price paid at the time of order is guaranteed and final: it will not be revised in the event of variation in the price of gold or diamonds between order and delivery.

4. Order

To place an order, the customer selects one or more products, checks the order summary (products, price, any fees, delivery address) and proceeds to payment. The order is only final once payment is confirmed and a confirmation email is sent by JOAR Paris. JOAR Paris reserves the right to refuse or cancel any order in the event of product unavailability, an obvious pricing error, or suspected fraud, in which case the customer will be informed and fully refunded.

5. Payment

Payment is made online, at the time of order, by credit card (Visa, Mastercard), Google Pay or Apple Pay. Transactions are secured by our payment provider; JOAR Paris does not store customers' bank details.

6. Manufacturing and delivery times

Manufacturing time: unless otherwise stated on the product page (some models available immediately from stock), all jewelry is made to order and requires a manufacturing time of 3 to 5 weeks before shipping. This time is in addition to the delivery time indicated below.
Delivery time (after shipping):
• Metropolitan France: 3 to 5 business days
• European Union and international: 7 to 11 business days on average
These times are given for guidance only. For international deliveries in particular, the time may be significantly extended due to customs formalities, local postal specifics or exceptional circumstances beyond our control. JOAR Paris cannot be held liable for a delay attributable to the carrier or customs authorities. The carrier is selected by JOAR Paris according to the destination and may vary from one order to another. Standard delivery is free for all orders, regardless of destination. All shipments are insured and require a signature upon receipt, to guarantee the security of your order.

7. Customs duties and import taxes (outside the European Union)

For deliveries outside the European Union, customs duties, local taxes or import fees may be applied by the authorities of the destination country. These customs fees are separate from the price paid to Joar and remain entirely the customer's responsibility. We recommend checking with local customs authorities before ordering.

8. Transfer of ownership and risk

Ownership of the products transfers upon confirmation of payment. The transfer of risk (loss, theft, damage) occurs upon delivery, the product being insured until that date.

9. Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, you have a period of 14 days from receipt of your order to exercise your right of withdrawal, without having to justify a reason. To exercise this right, contact us at contact@joar.paris before this period expires.
• Return shipping costs are the customer's responsibility.
• The refund is made within a maximum of 7 days from receipt of the returned product, using the same payment method used for the order.
• The product must be returned unworn, in its original condition and complete (case, certificates, tags) to be accepted.
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products made to order or clearly personalized (specific size, choice of stone, type of gold, etc.). These products can neither be returned nor refunded, except in the case of a conformity defect or hidden defect.

10. Applicable law and competent jurisdictions.

These Terms are governed by French law. In the event of any difficulty arising in connection with the interpretation or performance of these Terms, or the order or delivery of Jewelry sold on the Site, we invite you to send us any request for an amicable resolution, by registered letter with acknowledgment of receipt to the following address: JOAR PARIS SAS - 57 BOULEVARD MURAT, 75016 PARIS FRANCE. We undertake to respond within 15 (fifteen) days. Failing a satisfactory agreement, you have the option of referring the matter free of charge to a consumer mediator for an amicable resolution of any dispute with the Company.

JOAR Paris cannot be held liable for the non-performance or delayed performance of its obligations resulting from a case of force majeure, nor for damages resulting from improper use of the products by the customer.

12. Personal data

Personal data collected as part of your order is processed in accordance with our Privacy Policy, available on our website.

13. Intellectual property

The JOAR Paris brand, the content of the website (texts, images, creations) and the graphic elements are protected by intellectual property law and remain the exclusive property of JOAR Paris SAS. Any reproduction is prohibited without prior authorization.

14. Consumer mediation

In accordance with article L612-1 of the French Consumer Code, in the event of a dispute not resolved directly with our customer service, you may use the services of a consumer mediator of your choice free of charge. You can also use the European online dispute resolution platform:

15. Applicable law and competent jurisdiction

These Terms are governed by French law. If you reside in another country, particularly within the European Union, the mandatory consumer protection provisions of your country of residence may also apply. Failing an amicable resolution or resolution through mediation, any dispute falls under the jurisdiction of the competent courts, subject to the mandatory rules applicable to consumers.

16. Amendment of the Terms

JOAR Paris reserves the right to modify these Terms at any time. The applicable Terms are those in effect on the date of the order.
